These Terms of Service (“Terms”) govern your use of DearFutureUs.io (“Service”), operated by Ghostpilot Software (“we,” “our,” or “us”). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our digital relationship time capsule service. If you do not agree to these Terms, you may not use the Service.

Account Terms

• You must be at least 13 years old to use this Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account and password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• One person or legal entity may not maintain more than one free account

Acceptable Use

DearFutureUs.io is designed for creating heartfelt, personal time capsules for your loved ones. You agree NOT to use the Service to:

• Upload, share, or store any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload content that infringes on any patent, trademark, copyright, or other proprietary rights
• Upload content containing child sexual abuse material (CSAM) or any content sexualizing minors
• Upload malware, viruses, or any code designed to harm our Service or its users
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any commercial or business purposes without our written consent
• Harass, stalk, or harm another person through the Service
• Impersonate any person or entity
• Use the Service to send spam or unsolicited messages
• Interfere with or disrupt the Service or servers connected to the Service

We reserve the right to terminate accounts and remove content that violates these terms without notice or refund.

Fair Use Policy

Our paid subscription plans offer “unlimited” capsule creation under a Fair Use Policy. This policy ensures that all users have a great experience and that our service remains sustainable.

What Fair Use Means

Fair Use means using DearFutureUs.io as intended: creating personal time capsules for yourself, your partner, family members, and close friends. The Service is designed for meaningful, personal communication—not bulk storage or commercial use.

What Violates Fair Use

Enforcement

If we determine your usage exceeds Fair Use, we will first contact you to discuss your needs. In most cases, we can work together to find a solution. We may offer enterprise pricing for legitimate high-volume needs. We reserve the right to limit, suspend, or terminate accounts that abuse the Fair Use Policy.

Content Ownership

Your content belongs to you. You retain all ownership rights to the content you create and upload to DearFutureUs.io, including text messages, photos, and videos.

By using our Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service to you. We will never use your content for advertising, sell it to third parties, or share it without your consent.

Subscriptions and Payments

• Paid subscriptions are billed in advance on a recurring basis (yearly or multi-year)
• All payments are processed securely through our payment provider
• Prices are subject to change with 30 days notice to existing subscribers
• You may cancel your subscription at any time through your account settings
• No refunds are provided for partial subscription periods
• Capsules don't expire: If you cancel your subscription, your existing capsules remain accessible and will still unlock on their scheduled dates

Free Tier

Our free tier (“Sweet Beginnings”) allows you to create up to 3 text-only time capsules. Free accounts are subject to the same Terms of Service and Acceptable Use policies as paid accounts.

We reserve the right to delete free accounts that have been inactive for more than 12 months, with 30 days email notice before deletion.

Service Availability

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. We may occasionally need to perform maintenance or updates that temporarily affect availability.

We are not liable for any delays or failures in capsule delivery due to circumstances beyond our reasonable control.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or completeness of any information provided through the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTPILOT SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or the like that may be transmitted through the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Ghostpilot Software and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email and/or by posting a notice on our website at least 30 days before the changes take effect.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
